
Balancing autonomy and adult safeguarding: how effective is informed consent in restrictive practices authorisation in Queensland residential aged care homes?
Australian residential aged care homes are required to obtain informed consent to use a restrictive practice, from either the resident, or where the resident has impaired capacity, a substitute decision-maker appointed by state law. This research will combine doctrinal analysis and empirical research to examine the effectivness of the informed consent model as a safeguarding mechanism within the current aged care regulatory environment. The research will explore the evolution of restrictive practice regulation, the application of Queensland substitute decision-making laws and the human rights, ethical and practical implications of an informed consent model for restrictive practices in residential aged care.
